RODRAG RACING SPORTS CLUB ASSOCIATION, based in Arad, Calea 6 Vânători str., no. 55, established by the conclusion no. 13374 of November 23, 2023, fiscal identification code 49351489, legally represented by the president Ms. Ghita Raluca Adriana, (hereinafter referred to as the "Organizer"), in her capacity as the organizer of sports competitions that consist in the running of acceleration races (Drag type Racing), organized under the tutelage of the Romanian Motor Sports Federation (hereinafter referred to as "FRAS"), establishes this regulation, which has as objectives
- establishing the terms, conditions, internal rules, through which the athletes will be able to register and participate in the sports competitions organized by the Organizer;
- regulation of internal rules;
- regulation of personal data protection methods.
1. Enrollment of Athletes in Drag Racing Competitions
1.1. Registration of participants in the sports competition is done exclusively online, by accessing the website www.rodrag.ro. An individual account will be created here where the registration form for the competition is filled out. Based on this form, the following will be paid: the registration fee together with the mandatory insurance. The handover of the pilot's license will be done personally by the Organizer, on the day of the competition. There is NO return policy for this service.
1.2. In order to participate in the sports competitions organized by the Organizer, the athletes will pay the registration fee, in the amount of 500 RON per car.
1.3. The athlete will register with all personal data, the data of the car with which he will participate in the competition and its technical specifications. The athlete will complete the online registration form and sign it on the date of the sports competition.
1.4. The car entered by the athlete must, based on the technical criteria mentioned in the Framework Regulation for the conduct of acceleration races at the events organized by the RoDrag Racing Sports Club Association (hereinafter referred to as the "Regulation"), fall into one of the groups provided for in the Regulation (SemiPro /Pro) to participate in the Organizer's competitions.
1.5. By signing the registration form, the athlete declares that he has analyzed and agrees with the content of the Regulation, as well as with the Terms and Conditions established by this document.
2. Administrative and Technical Verification
2.1. Before the start of the competition, the athlete will show up with the car, respecting the schedule and location as detailed in the Regulations, in order for the Organizer to carry out the administrative and technical check.
2.2. During the administrative verification, the athlete will present the driving license and pilot's license to the Organizer in accordance with the Terms and Conditions of this document.
2.3. At the same time, the athlete will present to the Organizer the signed registration form, the registration certificate or any other document that shows the right of ownership of the cars with which the athlete intends to participate in the competition or the right to use those cars in Drag Racing sports competitions , as well as any other documents considered relevant by the Organizer.
2.4. If the athlete does not present the documents mentioned in these Terms and Conditions, the Organizer may refuse to validate the registration for the sports competition.
2.5. During the technical check, the Organizer will proceed to inspect the cars entered in the competition, according to the registration form presented by the athlete. The equipment of the cars must coincide with the details declared by the athlete in the registration form.
2.6. Once the Organizer has completed the technical check, the athlete cannot make any other changes to the cars entered in the competition, with the exception of changing the tires with others with the same specifications (o.d. or not) or reprogramming the car's computer.
2.7. For the avoidance of any doubt, the athlete's invocation of the remedy of some defects by changing some parts of the car entered in the competition does not represent an exoneration from the obligation to carry out the administrative and technical check after making the necessary changes.
2.8. Any car with insufficient security features or that does not comply with the regulations in force will not be admitted or will be disqualified from the sports competitions organized by the Organizer.
2.9. During the technical check and after it, the car must wear the contest number at all times. Starting without a competition number leads to the disqualification of the car from the competition. The athlete has the obligation to report the loss of the competition number as soon as he notices this aspect.
2.10. Additional checks may be carried out at any time during sports competitions, in the case of cars showing obvious signs of an accident that could have affected their safety. Cars deemed inappropriate will not be authorized to continue the race.
2.11. The athlete will be able to request additional checks at any time during the sports competitions, if he notices any element or has any suspicion regarding the damage to the integrity and security of the car.
3. Conditions for Effective Participation in Competitions
3.1. Athletes can participate in the competitions organized by the Organizer only under the condition of holding a category B driver's license and a driving license for Drag Racing, valid for the current year, issued by FRAS.
3.2. Holders of a valid national or international license for Drag Racing sports competitions issued by the competent Sports Authority of another state belonging to the E.U. or non-EU will be issued a FRAS license according to the special equivalence procedure or based on the bilateral agreements in force concluded between FRAS and the respective authority.
3.3. In order to participate in the competitions organized by the Organizer, athletes must have a valid insurance that covers the risks involved in participating in drag racing competitions.
3.4. Athletes must be medically fit to participate in sports competitions organized by the Organizer
3.5. In addition to the athletes registered in the competition, other drivers can also line up at the start with the same car, provided they hold a license for the respective competition and meet the conditions regarding insurance and health status.
3.6. Athletes are required to use a motorsport helmet and safety belt approved for the Semi-PRO groups during the sports competitions organized by the Organizer, and in addition, flame-resistant clothing for the PRO class. The athlete's safety equipment must be FRAS/FIA approved or conform to FRAS/FIA approved standards.
3.7. If, during the competition, the condition of the vehicle registered and verified according to article 2 hereof changes from that provided on the registration form, the athlete must present himself in order to carry out a reassessment and reclassification.
3.8. For the avoidance of any doubt, by changing the condition of the car is understood including, but not limited to the type of car, the driver who will drive the car, supercharging, transmission, etc.
3.9. Failure to comply with Article 3.5 of these Terms and Conditions leads to disqualification of the athlete from the sports competition.
3.10. It is forbidden to enter the competition track for competitors or cars that did not appear for the administrative and technical check and/or that did not receive the right to participate in the competition following these checks.
3.11. During the entire period of the sports competition, the athlete declares that he will respect both the specific rules of the competition and the instructions of the race officials.
4. General Liabilities
4.1. The athletes are responsible for the technical compliance of the cars entered in the sports competition throughout its duration. Any deviation will be sanctioned with exclusion from the competition by the Organizer.
4.2. Given that certain milestones are sealed, marked, the athlete is responsible for keeping them intact until the end of the competition. The lack of markings or seals leads to exclusion from the competition, unless otherwise provided by the Regulations.
4.3. It is also the responsibility of the athletes to see that any part of the car that has been tampered with during the check is correctly reinstalled. Any fraud discovered and in particular in relation to the identification marks presented as original and untouched, but in fact forged, will lead to the exclusion of the driver of the respective car from the competition. At the same time, the case will be forwarded to the Disciplinary Commission of FRAS with the proposal of suspension for a number of future stages of Drag Racing sports competitions.
4.4. Athletes are prohibited from consuming alcoholic beverages and drugs or any psychoactive and/or psychotropic substances for the entire duration of the sports competitions organized by the Organizer. The organizer will have the right throughout the sports competitions to carry out random tests in this regard. Failure to comply with this rule is punishable by the payment of 2,000 Lei and the suspension of the pilot's license for the current competitive year.
4.5. The technical teams, the athletes, have the obligation to leave the allocated technical area to the organizer, clean, without traces of liquids, rubber, parts, packaging, etc. Household garbage will be stored in bags/dumpsters located in the area.
4.6. Athletes/Technical Teams/spectators are prohibited from "Working with open fire".
4.7. During the movement of vehicles participating in the sports event (cars, platforms, trucks, etc.), the itineraries established by the Organizer and the travel speed will be respected. Given the fact that the travel routes are not considered public roads, any traffic incident will be the responsibility of the person/s involved, the Organizer being exempted from any problem from this point of view.
4.8. Spectators will be allowed access to the event with personal cars. They can be parked in specially designated spaces, following the instructions of the volunteers, so that no blockages are created and the access of emergency vehicles is possible at any time. The organizer is not responsible for equipment or objects left unattended by spectators in personal, parked cars.
4.9. It is strictly forbidden to perform launches, drifts, burnouts with any type of car on the travel itinerary by athletes or spectators. Any intention will be sanctioned with immediate removal from the event area.
4.10. At the end of the competition on the first day, the athletes, the technical teams, the spectators, will leave the organizing area. Access, camping, parking in the area where the event is organized during the night is strictly prohibited.
4.11. The organizer, event officials, employees and their representatives are absolved from any liability for material damage caused during the sports competitions, both in the cold park and on the track.
4.12. For any skids, collisions, as well as for any other incidents/accidents, on the race surface, in the cold park or on the access route, the responsibility lies exclusively with the participating athletes, considering the fact that they participate in the sports competitions organized by the Organizer on their own liability.
4.13. Collisions with track equipment, to the extent that it was not caused by technical problems (including the timing equipment), leads to immediate disqualification and to bearing all damages caused to the Organizer.
4.14. Collisions with the track equipment, especially the beacon lights on the race surface and/or in the cold park, will be the responsibility of the person who causes the damage, being obliged to bear the cost of their replacement, to the Organizer.
4.15. The organizer is not responsible for equipment or objects left unattended by athletes in the cold park.
4.16. By participating in sports competitions organized by the Organizer, the athlete understands that both the Regulations and these Terms and Conditions will govern the conduct of all sports competitions and, by participating in these events, the athlete agrees to comply with them.
4.17. Also, by participating in sports competitions organized by the Organizer, the athlete understands and agrees that the Organizer does not offer any guarantee regarding the safety of participation in these competitions by simply following the Regulations and these Terms and Conditions. They are intended as a guide to the conduct of sporting competitions and are in no way a guarantee against property damage, injury or death to a participant, spectator or official.
4.18. The organizer does not assume responsibility for any possible material or moral trauma, all of which are the sole responsibility of the participant
4.19. Athletes undertake to inspect the race surface and the race track to inform themselves about any defects, obstacles or any aspect that, in their opinion, represents an element of insecurity and must report this aspect to the Organizer, in writing, in the as short a time as possible. Any athlete understands and accepts that by participating in the competition without reporting any non-conformity he is deemed to have inspected the track and all conditions are satisfactory and acceptable to him.
4.20. Also, by participating in the sports competitions organized by the Organizer, the athletes declare that they are aware of the fact that Drag Racing involves risks and assume the risks in full knowledge of the case.
5. Intellectual and Industrial Property Rights
5.1. RODRAG RACING SPORTS ASSOCIATION processes personal data by automated/manual means, collects, uses and provides personal data provided by participants, only to achieve the purposes for which they were collected (see point 1 - Enrollment of athletes in Drag Racing type competitions) , in accordance with the provisions of "Regulation (EU) 2016/679 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC".
5.2. Any athlete who wishes to compete in the sports competitions organized by the Organizer gives his consent for the RODRAG RACING SPORTS ASSOCIATION to process personal data, as well as to collect personal data during participation in the competition, in accordance with the legal provisions in force.
5.3. By using the identification data, his name, image, medical data, he understands and accepts the fact that the Organizer has the image right over the organized sports competitions and can use the photo and video images in which both the athletes and their cars appear, taken both by its own staff and by spectators in various materials made before, during and after sports competitions and waives any rights it may have in this regard.
5.4. The athletes take note of the fact that the Organizer, its authorized contractual partners, members of the press, other visitors and other third parties may make audio and image recordings of sports competitions.
5.5. Therefore, all athletes participating in sports competitions, give the Organizer express permission to record and publish their image, appearance and actions. The person who will make the recordings according to the above-mentioned rules will obtain transferable and exclusive rights of use that are unrestricted in time, geographical location and form of use with respect to the athletes' recordings, but any presentation of said images must be in connection with the said competition sportive.
5.6. The organizer and the persons authorized by it have the unrestricted right to obtain profit, to use (in particular for the purpose of promoting the sports competition), to copy, publish, publicly broadcast and distribute such recordings of athletes without the need to pay him for this.
5.7. Athletes participating in sports competitions expressly take note of the fact that the Organizer may record the event, copy the recordings and distribute them by image-bearing means, broadcast them or otherwise make them public and may do so repeatedly , including by informing the public about the respective sports competitions, by means of cable data transmission or by any other means in the mass media or in the virtual space.
5.8. Athletes participating in sports competitions do not have the right, within the limits of the legal provisions, to raise claims against the Organizer in relation to their recordings and publication as provided above.
5.9. During the event, the unauthorized use of drones to obtain images, videos, etc. is prohibited. Any overflight request will only be made with the express approval of the Organizer.
5.10. Spectators have the right to make audio and video recordings of sports competitions, but only with the help of a sound and video recording tool built into a telecommunications device used for personal purposes (for example, a mobile phone or tablet) or with other non-professional equipment.
5.11. Spectators may not, without the prior consent of the Organiser, sell, use in exchange for a price or use for free for commercial purposes, the image and voice recordings they have made, identify the athletes appearing in those recordings without their consent , or violate the personal rights of other viewers.
5.12. The organizer, expressly, is not responsible for the violation of the above-mentioned rules by the spectators.
5.13. The organizer reserves the right to establish areas/locations where photography/filming is prohibited. In case of non-compliance, the Organizer has the right to confiscate the camera/video until the end of the sports competition and to delete the respective recordings.
The organizer reserves the right to change the competition rules or cancel the competition at any time without prior notice.
